อุตสาหกรรมการท่องเที่ยวถือว่าเป็นอุตสาหกรรมที่มีความสำคัญอย่างยิ่งต่อการขับเคลื่อนระบบเศรษฐกิจ ทั้งยังเป็นกลไกสำคัญในการกระจายรายได้ไปสู่ท้องถิ่น ซึ่งหลังจากเกิดการแพร่ระบาดของเชื้อไวรัส COVID-19 ทำให้ส่งผลกระทบต่ออุตสาหกรรมท่องเที่ยวของไทยและทั่วโลกเป็นอย่างมาก ซึ่งภายหลังที่การแพร่ระบาดของโรคลดลง การเปิดประเทศเพื่อกระตุ้นเศรษฐกิจจากนักท่องเที่ยวต่างชาติจึงมีความจำเป็นเป็นอย่างมาก ซึ่งธุรกิจการท่องเที่ยวและมัคคุเทศก์ถือว่าเป็นธุรกิจหนึ่งที่เป็นหลักสำคัญในการฟื้นฟูการท่องเที่ยวของประเทศไทย แต่เนื่องจากมาตรการทางกฎหมายในการควบคุมธุรกิจการท่องเที่ยวและมัคคุเทศก์ของไทยยังคงมีช่องโหว่ทางกฎหมาย และในการแก้ไขปัญหายังไม่ตอบสนองต่อปัญหาที่เกิดขึ้นเท่าที่ควร ดังนั้นจึงเห็นควรให้รัฐมีการแก้ไขรูปแบบการขอใบอนุญาตของผู้ประกอบธุรกิจท่องเที่ยว ควรกำหนดหลักเกณฑ์ในการวางหลักประกันของธุรกิจการท่องเที่ยว ให้ครอบคลุมต่อปัญหาและมีความเหมาะสมตามประเภทของธุรกิจท่องเที่ยว ควรมีมาตรฐานในการกำหนดคุณสมบัติในการขอใบอนุญาตประกอบอาชีพมัคคุเทศก์ให้ได้มาตรฐานและป้องกันการเข้ามาประกอบธุรกิจของคนต่างด้าว โดยนำแนวทางของต่างประเทศ ได้แก่ สิงคโปร์ ไต้หวัน และสาธารณรัฐสังคมนิยมเวียดนาม รวมถึงพิจารณาแนวทางส่งเสริมจากสาธารณรัฐมาเลเซียเพื่อแก้ไขบทกฎหมายของไทยให้เหมาะสมเพื่อยกระดับอุตสาหกรรมการท่องเที่ยวของไทย รัฐควรให้การส่งเสริมและฟื้นคืนความเชื่อมั่นในการเดินทางท่องเที่ยวผ่านการเสริมสร้างความปลอดภัยในการเดินทางท่องเที่ยวแก่นักท่องเที่ยว

Among them, tourism and tour guide business are considered as one of the core businesses of Thailand's tourism revitalization. However, due to legal measures to control the tourism business and tour guides in Thailand, there are still legal loopholes. As a result, the law still does not cover the case and there is no proper response to the problems when solving the problems. Therefore, it is seen that the government should amend the obtaining the license for tourism business. Criteria for placing collateral for tourism businesses should be established to cover the event of problems and should be appropriate according to the type of tourism business. There should be standards for determining the qualifications for applying for a tour guide license to meet standards and prevent foreigners from entering business. By introducing foreign practices, including Singapore, Taiwan, and the Socialist Republic of Vietnam. Including considering promotional guidelines from the Republic of Malaysia to amend Thai laws to be appropriate. To raise the level of Thailand's tourism industry. The government should promote tourism and restore confidence in traveling through enhancing travel safety for tourists
