Trespassing by the Mass Media on the Rights of People in the Entertainment Business

Abstract
The objectives of this study are to analyze news in newspapers that involve trespasseson the rights of people in the entertainment business, and to look into the decisionsof entertainment news editors regarding news reporting and publication which comesclose to trespassing on the rights of people in the entertainment business. The method ofthis study consists of analyzing the essence of the news that involves trespassing onthe rights of people in the entertainment circle on the front page, continuation of thenews on the inside pages, and the entertainment news pages, including in-depthinterviews of entertainment news reporters in daily newspapers, namely Thairath,Daily News, Khaosod, Kom Chad Leuk, from 2002 to 2005, totaling 5,840 issues.The outcome of the study may be summarized as follows:1. The results of the analysis revealed that there are 3 groups of trespassers:the mass media, non - mass media, and paparazzi. The mass media represent the largestgroup, comprising 86.6% of the total number of trespassers. According to this study onthe nature of the trespasses in contravention of the laws, it was found that most ofthem were trespasses on personal rights to privacy. Next in line were torts, defamationsand nuisances, respectively. People in the entertainment business are victims most of all of trespasses on their privacy in regard to sexual affairs. In response, they confront theadverse consequences of news reporting that trespass on their rights mostly by givinginterviews to set the record straight or rebut news reports that trespass on their rights. Thisrepresents 81.46% of all the cases. An interesting aspect about the filing of lawsuitsby people in the entertainment business is that they seldom file lawsuits against themass media for trespasses on their rights, but file lawsuits against other groups oftrespassers who are not part of the mass media. It was found that regarding showinga spirit of responsibility, the mass media mostly tend to take no action to rectify theerrors, or apologize for the rights trespassing news, representing 95.80% of the cases.2. The results of looking into the decisions of entertainment news editors on thenews reporting and publication which come close to trespassing on the rights of peoplein the entertainment business revealed that although the entertainment news editorsare aware that the news reporting in question is illegal, they nonetheless give it thegreen light. Competition in the reporting and selling of news that consumers like is themost decisive factor for trespassing on the rights of people in the entertainment business.
